SISTEM SHOPEE PAYLATER DITINJAU DARI SEGI HUKUM ISLAM (Studi Di Civitas Akademik IAIN Bone)

ABSTRAKÂ Â Â Â Â Â Â Â Â Â Â Â Â
Artikel ini membahas mengenai sistem shopee paylater ditinjau dari hukum Islam (studi Di civitas akademik IAIN Bone). Pokok permasalahannya yaitu bagaimana mekanisme akad jual beli menggunakan shopee paylater di civitas akademik IAIN Bone dan bagaimana tinjauan hukum Islam terhadap denda atas keterlambatan pembayaran pada shopee payalater di civitas akademik IAIN Bone. Penelitian ini menggunakan penelitian lapangan (field research) yang bersifat kualitatif dengan menggunakan 2 pendekatan yaitu: pendekatan yuridis empiris dan pendekatan teologis normatif.
           Penelitian ini bertujuan untuk mengetahui mekanisme akad jual beli menggunakan shopee paylater di civitas akademik IAIN Bone dan tinjauan hukum Islam terhadap pengenaan denda keterlambatan praktik menggunakan shopee paylater.
           Hasil penelitian ini menjelaskan bahwa syarat mengaktifkan shopee paylater adalah harus memiliki akun shopee yang sudah tervertivikasi oleh pihak shopee dan wajib memiliki KTP setelah itu data sudah diinput, maka akan disetujui oleh pihak shopee dan saldo pinjaman akan muncul secara otomatis, sistem pembayarannya melalui cicilan 2 kali, 3 kali, 6 kali, dan 12 kali perbulannya, pembayaran tagihannya bisa melalui m-banking, atm, indomaret, alfamart, atau pembayaran lainnya, suku bunga di shopee paylater antara 0% hingga 2,95% perbulan tingkat bunga cicilan shopee paylater adalah 0% dan jadwal pembayarannya bisa 30 hari atau 1 bulan dengan bunga 0% suku bunga untuk cicilan 2-3 bulan adalah 2,95%, biaya penanganan setiap pertransaksi 1% dan ketika pengguna terlambat membayar saat jatuh tempo akan dikenakan denda sebanyak 5% jika ada keterlambatan pembayaran tagihan yang terus menerus akan berdampak pada pembatasan akses fungsi di aplikasi dan data pribadi akan dilaporkan ke SLIK OJK.  Dimana shopee paylater hukumnya ada dua yaitu boleh dan haram dikatakan boleh karena denda tersebut termasuk hukuman denda dan dikatakan haram karena di dalam  shopee payalater menerapakan denda apabila terjadi keterlambatan pembayaran oleh konsumen, hal tersebut tidak sesuai ketentuan jual beli menurut pandangan hukum Islam yaitu berkaitan dengan riba karena jika mengandung denda keterlambatan maka hukumnnya riba, di dalam denda keterlambatan pada shopee paylater sudah jelas mengandung riba. Di dalam Islam denda keterlambatan dikenal dengan istilah riba jahiliyah, yaitu riba yang muncul karena adanya keterlambatan pembayaran oleh peminjam.
 ABSTRACT
    This article discusses the shopee paylater system in terms of Islamic law (case study in the IAIN Bone academic community). The main problem is what is the mechanism for buying and selling contracts using Shopee Paylater in the IAIN Bone academic community and how Islamic law reviews fines for late payments on Shopee Paylater in the IAIN Bone academic community. This research uses qualitative field research using 2 approaches, namely: an empirical juridical approach and a normative theological approach.Â
    This research aims to determine the mechanism of buying and selling contracts using Shopee Paylater in the IAIN Bone academic community and review Islamic law regarding the imposition of fines for late practice using Shopee Paylater. The results of this research explain that the conditions for activating Shopee PayLater are that you must have a Shopee account that has been verified by Shopee and must have an ID card. After the data has been input, it will be approved by Shopee and the loan balance will appear automatically, the payment system is in 2 installments. , 3 times, 6 times, and 12 times per month, bill payments can be made via m-banking, ATM, Indomaret, Alfamart, or other payments, the interest rate on Shopee Paylater is between 0% to 2.95% per month. The interest rate for Shopee Paylater installments is 0% and the payment schedule can be 30 days or 1 month with 0% interest, the interest rate for 2-3 month installments is 2.95%, the handling fee for each transaction is 1% and if the user is late in paying when due, they will be subject to a 5% fine if Continuous delays in bill payments will result in restrictions on access to functions in the application and personal data will be reported to SLIK OJK. Where Shopee Paylater has two laws, namely permissible and haram, it is said to be permissible because the fine includes a fine and it is said to be haram because Shopee Paylater imposes a fine if there is a delay in payment by the consumer, this is not in accordance with the provisions of buying and selling according to Islamic law, which is related to usury. because if it contains late fines then the penalty is usury, the late fines on Shopee Paylater clearly contain usury. In Islam, late fines are known as usury jahiliyah, namely usury that arises due to late payments by the borrower.
