In Islam, in an event of death, the transfer of wealth is the right thing to do for families who are still alive. Islamic inheritance has been determined by Allah and His Messenger Muhammad, so there is a standard inheritance, also its development in the form of the companions’ ijma and contemporary Islamic legal expert opinion.
Kalalah inheritance is an inheritance law provisions in the event of certain conditions, namely the death of a person is extinct, do not leave parents or children. The specific inheritance kalalah has been referred to in verse 12 and 176 Surat an-Nisa '. Determination of portion of the relatives’ inheritance rights in these two verses of kalalah are 1/2, 1/6, 1/3, and 2/3.
This paper describes the division of the inheritance rights of siblings of the same parents, or of the same father only or the same mother. Kalalah conditions are very likely to occur, so there is a need to analytical study that is useful in the establishment and development of inheritance law kalalah. This paper opens academic access to academicians, justice practitioners and community.
